Public Offer

1. General Provisions

1.1. This document constitutes the official public offer of LLC "LATEXFAUNA" (hereinafter referred to as the "Seller") to enter into a distance sales agreement for Goods offered through the Latexfauna Online Store.

1.2. By placing an order on the website, the Buyer fully and unconditionally accepts the terms and conditions of this Public Offer.

1.3. This Public Offer has been prepared in accordance with:

  • the Civil Code of Ukraine;

  • the Law of Ukraine "On Electronic Commerce";

  • the Law of Ukraine "On Consumer Protection".

2. Terms and Definitions

Seller — LLC "LATEXFAUNA".

Buyer — an individual who places an order through the Online Store.

Online Store — the website through which Goods are offered and sold remotely.

Goods — products offered for sale on the Online Store.

Order — a properly completed request submitted by the Buyer to purchase Goods.

3. Subject of the Agreement

3.1. The Seller undertakes to transfer ownership of the Goods to the Buyer, and the Buyer undertakes to pay for and accept the Goods in accordance with the terms of this Public Offer.

3.2. Information regarding the Goods, including their characteristics, availability, and current prices, is provided on the Online Store website.

3.3. Images of the Goods displayed on the website may slightly differ from the actual appearance of the Goods due to differences in screen color rendering.

4. Order Placement

4.1. Orders are placed independently by the Buyer through the Online Store.

4.2. To place an Order, the Buyer must provide accurate and up-to-date information.

4.3. After an Order is placed, the Buyer receives confirmation through the website or via the contact details provided during checkout.

4.4. The Seller reserves the right to refuse to fulfill an Order in the following cases:

  • the Goods are out of stock;

  • incorrect or false information has been provided;

  • it is impossible to contact the Buyer;

  • circumstances arise that make fulfillment of the Order impossible.

5. Payment

5.1. Payment for the Goods shall be made using the payment methods available on the Online Store.

5.2. Payments made by bank card are processed through secure payment service providers.

5.3. The Online Store does not store Buyers' full bank card details.

5.4. All prices displayed on the website are stated in Ukrainian Hryvnias (UAH).

6. Delivery

6.1. Delivery of the Goods is available within the territory of Ukraine using the delivery services available during checkout.

6.2. Delivery times depend on the operation of the delivery services and may change independently of the Seller.

6.3. The risk of accidental loss of or damage to the Goods passes to the Buyer once the Goods are handed over to the delivery service.

7. Returns and Exchanges

7.1. The Buyer has the right to exchange or return the Goods in accordance with the legislation of Ukraine.

7.2. Returns or exchanges are possible provided that:

  • the Goods retain their original condition;

  • there are no signs of use;

  • all tags and original packaging are preserved;

  • proof of purchase is provided.

7.3. Certain categories of Goods are not eligible for return or exchange in accordance with the applicable legislation of Ukraine.

8. Liability

8.1. The Parties shall be liable in accordance with the legislation of Ukraine and the provisions of this Public Offer.

8.2. The Seller shall not be liable for:

  • delivery delays caused by delivery service providers;

  • temporary technical failures of the website;

  • improper use of the Goods by the Buyer.

9. Personal Data

9.1. By placing an Order, the Buyer confirms acceptance of the Store's Privacy Policy and consents to the processing of their personal data.

10. Force Majeure

10.1. The Parties shall be released from liability for failure to perform or improper performance of their obligations where such failure results from force majeure circumstances.
